Terms of Service

You must be at least 18 years old to create an account. Brain Ninjas is intended for use by parents and legal guardians who create and manage educational profiles for their children. Children do not create accounts and are not parties to these Terms.

By registering, you confirm that you are the parent or legal guardian of any child profile you create, and that you have the authority to consent to the collection and use of data as described in our Privacy Policy.

Brain Ninjas provides browser-based educational games for children ages 3–11, an AI tutoring assistant (Kian), parent progress reports, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Free Plan: Includes access to selected free games and up to 3 child profiles. No credit card required.

Premium Plan: $9.99/month. Includes all games, unlimited child profiles, detailed progress reports, and new games added monthly.

• You are responsible for keeping your account credentials secure.
• You must notify us immediately if you suspect unauthorized access to your account.
• You may not share your account with others or create accounts on behalf of someone else without their permission.
• We reserve the right to terminate accounts that violate these Terms.

Premium subscriptions are billed monthly at $9.99/month via Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

• Cancellation: You may cancel at any time from your Parent Dashboard under Billing. Cancellation takes effect at the end of the current billing period. You retain access to Premium features through the end of the period you have paid for.
• Refunds: We do not offer refunds for partial billing periods. If you experience a technical issue that prevents you from using the Service, contact us within 7 days and we will evaluate your request on a case-by-case basis.
• Price changes:We will give you at least 30 days’ notice before changing the subscription price. Continued use after the effective date constitutes acceptance of the new price.
• Failed payments:If a payment fails, your account will move to “Past Due” status. We will attempt to notify you by email. Access to Premium features may be suspended until payment is resolved.

You agree not to:

• Attempt to circumvent, disable, or interfere with the security features of the Service.
• Use automated tools, bots, or scripts to access or scrape the Service.
• Attempt to reverse engineer, decompile, or extract source code from the Service.
• Use the Service to transmit harmful, offensive, or illegal content.
• Impersonate any person or entity or misrepresent your affiliation.
• Share your account credentials to give unauthorized access to the Service.
• Use the AI features to attempt to manipulate, jailbreak, or extract training data from the AI models.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

Brain Ninjas operates an AI content moderation system on all child-facing interactions. Despite our best efforts, no automated system is perfect. You agree to notify us immediately at support@brainninjas.com if your child encounters any inappropriate content through the Service.

You are responsible for supervising your child’s use of the Service and ensuring it is appropriate for your child’s age and developmental stage.

All content on the Service — including game code, graphics, mascot designs (Nani and Kian), text, and educational materials — is owned by Brain Ninjas or its licensors and is protected by copyright and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. You may not copy, reproduce, distribute, or create derivative works from our content without written permission.

Your use of the Service is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you agree to the collection and use of information as described in the Privacy Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. Educational outcomes depend on many factors and we make no guarantees about your child’s academic progress.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRAIN NINJAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration under the American Arbitration Association’s Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

You waive any right to participate in a class-action lawsuit or class-wide arbitration related to the Service.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

You may close your account at any time by contacting us at support@brainninjas.com. We may terminate or suspend your access immediately if you violate these Terms. Upon termination, your right to use the Service ceases and we will delete your data in accordance with our Privacy Policy.
